The Website is operated by KML Family Corporation (“Mancino’s,” “we,” “us,” or “our”).

By accessing or using the Website, creating an account, or submitting information through the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Website.

  1. Eligibility and Authorized Users

Website accounts and restricted community features are intended solely for authorized adults affiliated with Mancino’s, including approved franchisees and other individuals expressly granted access by Mancino’s.

You must be at least 18 years old to create or use a Website account.

By creating or using an account, you represent that:

  • You are at least 18 years old.
  • You are an authorized Mancino’s franchisee or another approved user.
  • The information you provide is accurate, current, and complete.
  • You will use the Website only for legitimate business purposes.
  • You will comply with these Terms and all applicable laws.
  • You have not previously been suspended or removed from the Website.

Account access is not available to the general public, minors, customers, or employment applicants unless Mancino’s expressly authorizes such access in writing.

Mancino’s may require verification of your identity, age, business affiliation, franchise status, or authorization before granting or continuing account access. We may deny, suspend, or terminate access if eligibility requirements are not met or can no longer be verified.

Employment applicants who are legally permitted to work at a younger age may submit an employment application where permitted by applicable law. Submitting an employment application does not create a Website account or provide access to restricted member areas.

The Website may also provide restricted member areas, franchisee resources, vendor resources, profiles, groups, activity feeds, discussion forums, messaging tools, and other community features.

Website information is provided for general informational purposes. Product availability, prices, ingredients, services, employment opportunities, franchise opportunities, and restaurant participation may vary by location.

  1. Franchise Locations

Many Mancino’s restaurants are independently owned and operated by franchisees.

An independently operated franchise location is responsible for its own:

  • Daily operations.
  • Employment decisions.
  • Customer transactions.
  • Local promotions.
  • Pricing.
  • Product availability.
  • Delivery and fulfillment.
  • Compliance with local requirements.

References to “Mancino’s,” “we,” or “our” in these Terms do not necessarily mean that Mancino’s, Inc. controls the daily operations or employment practices of an independently owned franchise location.

Questions or disputes concerning a particular transaction or visit may be referred to the applicable restaurant or franchise owner.

  1. Online Ordering, Rewards, and Mobile Applications

Links to ordering, rewards, delivery, mobile-application, or location services may direct you to a separate website, application, franchise location, or third-party provider.

Transactions completed through those services may be governed by separate terms, privacy policies, refund policies, and other conditions.

Mancino’s does not guarantee that every location will:

  • Participate in online ordering or rewards programs.
  • Offer the same menu, pricing, promotions, or delivery options.
  • Accept every payment method.
  • Honor an offer that is unavailable, expired, incorrectly displayed, or prohibited by law.

You are responsible for reviewing the terms presented during an order or transaction.

  1. Accounts and Registration

Certain Website features require an approved account.

When creating or using an account, you agree to:

Restricted access does not grant ownership of the content or waive any confidentiality obligation that otherwise applies.

We may modify access levels, remove content, revoke access, or discontinue restricted features at any time.

  • Contains malware, harmful code, deceptive links, or attempts to compromise the Website.
  • Attempts to collect information about other users without authorization.
  • Impersonates another person, company, employee, franchisee, moderator, or administrator.
  • Interferes with a discussion or the normal operation of the community.
  • Encourages users to violate these Terms.
  • Is otherwise inappropriate for the Website or its intended business community.

Disagreement is permitted; harassment is not. Users must communicate respectfully and remain focused on relevant business or community topics.

Member forums and restricted areas may contain nonpublic business information.

Unless information has been expressly identified as public, authorized users must treat restricted information as confidential and may use it only for the business purpose for which access was provided.

You may not disclose restricted information outside the authorized community, including through:

You retain any ownership rights you have in original content you submit.

By submitting content to the Website, you grant Mancino’s a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, format, adapt, distribute, and otherwise use that content as reasonably necessary to:

  • Display the content to its intended audience.
  • Moderate the community.
  • Maintain backups and records.
  • Protect the Website and its users.
  • Promote public portions of the Website, when appropriate.

This license continues for as long as the content remains on the Website or in our systems. Backup, archival, legal, and security copies may remain after content is removed.

By submitting an application, you represent that the information provided is truthful and complete. False, misleading, or omitted material information may result in rejection of the application or termination of employment where permitted by law.

Employment opportunities may be offered by KML Family Corporation. or an independently owned franchisee. The entity making the hiring decision is solely responsible for that decision and for the terms and conditions of employment.

Nothing on the Website creates:

  • An employment contract.
  • A promise of employment.
  • A guarantee concerning compensation, hours, benefits, duties, or duration.
  • A modification of an at-will employment relationship where permitted by law.

Mancino’s and its franchisees are equal-opportunity employers to the extent required by applicable law.

Applicants who are under 18 may submit an application where legally permitted to work. Such applicants are not eligible to create or use a Website member account unless they later become an authorized adult user and are expressly approved by Mancinos.

  1. Franchise Information

Information concerning franchise fees, investments, financial qualifications, training, timelines, estimated expenses, or business opportunities is general information only.

Website content is not a franchise offering and does not replace the applicable Franchise Disclosure Document or executed franchise agreement.

An offer to sell a franchise may be made only through legally authorized documents and only in jurisdictions where the offer is permitted.

No statement on the Website guarantees:

  • A particular location.
  • A particular opening date.
  • Revenue, profitability, or business success.

  • Access or attempt to access another user’s account.
  • Probe, scan, or test Website vulnerabilities without authorization.
  • Circumvent authentication or access restrictions.

  • Automate account creation or forum activity.
  • Use bots, scraping tools, or automated systems without written authorization.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANCINO’S, ITS AFFILIATES, FRANCHISEES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE.

THIS INCLUDES LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, OR REPUTATION, EVEN IF THE POSSIBILITY OF SUCH DAMAGES WAS KNOWN.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MANCINO’S ARISING FROM OR RELATING TO THE WEBSITE WILL NOT EXCEED THE GREATER OF:

  • Your violation of another person’s rights.

This obligation does not apply to the extent a claim results directly from Mancino’s own unlawful conduct.

This section does not prevent either party from seeking appropriate relief in small-claims court or requesting urgent injunctive relief where legally available.

Before filing a lawsuit concerning the Website, you agree to send us a written description of the dispute and allow at least 30 days for the parties to attempt an informal resolution.

Mancino’s should consult qualified legal counsel before adding a mandatory arbitration provision or class-action waiver.

Updated Terms become effective when posted unless a later effective date is stated. When appropriate, we may provide additional notice through email, an account notification, or the Website.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.

If you do not agree to an update, you must stop using the Website and may request closure of your account.

These Terms and the Privacy Policy constitute the general agreement between you and Mancino’s concerning the Website, subject to any separate written agreement that applies to you.

If there is a conflict between these Terms and an executed franchise, employment, vendor, confidentiality, membership, or other agreement, the executed agreement controls with respect to that conflict.

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver of that provision.

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations in connection with a restructuring, business transfer, or operation of the Website.

Headings are provided for convenience and do not affect interpretation.
